Web Site “Terms of Use” Policy for Coastguard Hibiscus Incorporated

Welcome to the website of Coastguard Hibiscus Incorporated (Coastguard), a registered incorporated society and charity in New Zealand (Charity Registration Number: CC34499). By accessing or using our website (www.coastguardhibiscus.org.nz), you agree to these Terms of Use.


1. Purpose and Activities


Coastguard is dedicated to saving lives at sea by providing assistance in the Hauraki Gulf, as outlined in our constitution and registered charitable purposes under the Charities Act 2005 and Incorporated Societies Act 2022. We operate rescue vessels manned by highly trained volunteer crews. All funds raised through donations or sponsorships via this website are used solely for these charitable purposes.


2. Governance


Coastguard is governed by a Committee per our constitution, comprising elected officers (President and Crew Chief) and appointed ex-officio officers (Secretary, Treasurer, Safety Officer, Maintenance Officer, Training Officer, Recruitment Officer).


3. Reliance on Volunteers


Coastguard relies 100% on highly trained volunteers to operate rescue vessels, fundraise (e.g., Coastguard New Zealand Summer Lottery ticket sales, grant applications), and manage the society.


4. Use of Donations

  • Donations (minimum $5) from New Zealand residents are used exclusively for Coastguard’s mission of saving lives at sea, as approved by Charities Services.

  • Donors giving $5 or more to Coastguard, a New Zealand Inland Revenue (IR) approved donee organisation, may claim a 33.33% tax credit, up to their taxable income, via myIR or IR526 forms.

  • Donation receipts are issued immediately for one-off donations or annually (by April) for regular donors, via email or post. Contact treasurer@coastguardhibiscus.org.nz for replacement receipts (marked “Copy”).

  • Refunded donations require donors to destroy receipts and notify Inland Revenue if a tax credit was claimed.


5. Payment Options and Fees

  • Card Payments: Processed via Stripe, a PCI-compliant payment provider, which charges a fee/transaction of 2.9% + NZ$0.30 for card payments. This fee is deducted from the donation.

  • Direct Bank Transfer: Alternatively, donate directly to our bank account to avoid processing fees. Email treasurer@coastguardhibiscus.org.nz with the required information to receive further instructions how to pay to our bank account and a valid donation receipt for tax purposes.

    • Full Name: Donor’s full name (and their partner’s name, if sharing credits)

    • Donation Amount: The exact amount donated (minimum $5 for tax credit eligibility) 

    • Date of Donation: The date the donation was made or the tax year 
(1 April to 31 March)

    • Contact Details: Email and postal address. A phone number may be required for verification.


6. Privacy and Data Protection

 

  •  We comply with the Privacy Act 2020 when collecting, using, storing, and protecting personal information (e.g., donor names, contact details, payment information).

  • Our Privacy Policy (www.coastguardhibiscus.org.nz/privacy) details how data is handled. By donating, you consent to this policy.

7. Compliance with Laws

  • Coastguard complies with the Incorporated Societies Act 2022, Charities Act 2005 and Privacy Act 2020.

  • We submit annual reports to Charities Services, per Section 102 of the Incorporated Societies Act 2022.

  • Coastguard may update these Terms of Use to reflect changes in our constitution or legal requirements. Updates will be posted on our website, and continued use constitutes acceptance.


10. Termination of Services

  • Coastguard reserves the right to suspend or terminate website access for suspected fraud, misuse, or violation of these terms, in line with our constitution and fair processes.


11. Liability and Disclaimers

  • Coastguard is a not-for-profit incorporated society under Section 8 of the Incorporated Societies Act 2022 and does not distribute profits to members.

  • We are not liable for errors in payment processing, website downtime, or third-party services (such as Stripe), to the extent permitted by law.

  • Website content is provided “as is” and should not be considered professional advice.
